0- Summary of Geloka's Terms and Conditions

Geloka is an online platform and mobile application allowing users to search for short- or long-term housing. By using our Services, you agree to these Terms and Conditions which define your rights and obligations. You must create an account to access certain features and provide accurate information. You are responsible for your account's confidentiality. Bookings and payments are processed via third parties, and cancellation policies vary by Owners. You must use the Services legally and in accordance with rules established by Geloka and Owners. 1- Definitions

• 'Geloka' or 'we' refers to the company whose headquarters are located in Cameroon, in the city of Douala. It is a platform allowing users to search for their best housing options on a long- or short-term basis
• 'Services' refers to Geloka's online platform and mobile application allowing users to search for housing on a long- or short-term basis
• 'User' or 'you' means any person accessing or using the Services
• 'Owner' or 'Landlord' means any person or entity listing a property for rent via Geloka's Services
• 'Tenant' means any person or entity searching for a property to rent via Geloka's Services

2- Acceptance of terms

• By accessing or using the Services, you confirm that you have read, understood and agreed to comply with these terms
• Geloka reserves the right to modify these Terms at any time. Changes will take effect upon their publication on our website or mobile application, and if significant, we reserve the free choice to provide you with more prominent notice with email notification. It is therefore your responsibility to regularly review these Terms to stay informed of any changes

3- Eligibility

• You must be at least 12 years old to use the Services. By using the Services, you confirm that you are at least 12 years old
• If you use the Services on behalf of an entity, you declare and warrant that you have the authority to accept these Terms on behalf of that entity and that the entity agrees to indemnify Geloka for any violation of these terms

4- User account

• To access certain features of the Services, you must create a user account. You agree to provide accurate, current and complete information when creating your account
• You are responsible for the confidentiality of your password and all activities that occur under your account. You agree to immediately notify Geloka of any unauthorized use of your account
• Geloka reserves the right to suspend or terminate your account at any time if it suspects that you have violated these Terms or for any other reason at its sole discretion

5- Use of services

• Permitted Use: You agree to use the Services only for lawful purposes and in accordance with these Terms

6- Bookings and Payments

• Bookings: Users can search for and book properties via the Services. The terms of each booking will be defined by the property Owner
• Payments: Payments for bookings will be processed via third-party payment platforms integrated with Geloka's Services. Geloka is not responsible for issues related to payments made via these third-party platforms
• Cancellations and Refunds: Cancellation and refund policies vary by Owner. It is your responsibility to read and understand these policies before making a booking

7- Owners' obligations

• Accuracy of Information: Owners agree to provide accurate and complete information about their properties
• Legal Compliance: Owners must comply with all applicable laws and regulations regarding property rentals
• Respect for Tenants: Owners must treat Tenants with respect and courtesy and provide properties as described in listings

8- Tenants' obligations

• Respect for Properties: Tenants agree to use properties responsibly and leave them in the same condition as upon arrival
• Compliance with Rules: Tenants must comply with rules established by Owners for property use
• Payments: Tenants must make all due payments on time and in accordance with terms agreed with Owners

9- Intellectual Property

• Geloka Content: All content of the Services, including but not limited to text, graphics, logos, images and software, is the property of Geloka or its licensors and is protected by intellectual property laws
• Limited License: Geloka grants you a limited, non-exclusive, non-transferable and revocable license to access and use the Services only for your personal, non-commercial needs
• Restrictions: You must not copy, modify, distribute, sell or rent any part of the Services or content without Geloka's prior written authorization

10- Data Protection and Privacy

• Data Collection and Use: Geloka collects and uses your personal information in accordance with its privacy policy, available on our website and mobile application
• Data Security: Geloka implements technical, administrative and physical security measures to protect your personal information against unauthorized access, use or disclosure
• Data Disclosure: Geloka may disclose your personal information if required by law or if it believes in good faith that such disclosure is necessary to comply with legal process, protect the rights, property or safety of Geloka, its users or the public

11- Warranty Limitations

• No Warranty: The Services are provided 'as is' and 'as available'. Geloka does not guarantee that the Services will be uninterrupted, error-free or secure
• Liability Exclusion: To the extent permitted by law, Geloka disclaims all liability for direct, indirect, incidental, consequential, special or punitive damages resulting from use or inability to use the Services

12- Indemnification

You agree to indemnify and hold harmless Geloka, its officers, employees and agents from all claims, damages, losses, liabilities, costs and expenses (including attorneys' fees) resulting from or related to your use of the Services, your violation of these Terms or your violation of any third-party rights

13- Termination

• Termination by Geloka: Geloka reserves the right to suspend or terminate your access to the Services at any time, without notice and at its sole discretion, if it believes you have violated these Terms or for any other reason
• Effect of Termination: Upon termination, your right to use the Services will cease immediately and you must cease all use of the Services. All provisions of these Terms that by their nature should survive termination will survive

14- Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Cameroon. Any dispute arising from or related to these Terms or your use of Geloka's Services will be subject to the exclusive jurisdiction of Cameroonian courts and dispute resolution will be solely through court and not arbitration

15- General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and Geloka regarding your use of the Services and supersede all prior or contemporaneous agreements, whether written or oral
• Severability: If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in full force
• Waiver: Geloka's failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of such right or provision
• Assignment: You may not assign or transfer your rights or obligations under these Terms without Geloka's prior written consent. Geloka may assign or transfer its rights and obligations without restriction
